1) Acceptance by you to Our Terms of Use
These terms apply to your use of the website (www.myconfession.com) (“the Site”). The Site is owned and operated by [insert details and address here] (“MyConfession”, “We”, “Us”, “Our”, “Ourselves”). By accessing or using the Site and/or uploading a confession onto the Site you agree that you are over 18 years of age and have read and understand these Terms of Use (“the Terms”) and agree to be bound by these Terms.
MyConfession reserves the right to change these Terms at any time without notice and will post any changes to the Terms on this page. Your continued use of the Site once the new Terms have been posted constitutes your acceptance and agreement to the new Terms.
2) Our Aim
We understand we are the only dedicated online visual confessional site in the Universe. The aim of this Site is to enable you to share your audio-visual confession with others by way of a file upload providing it complies with the Terms hereunder. Further details on how you may upload your file are set out in the ‘Help’ section.
3) Minimum User Age
The minimum age you must be to use and access this site is 18 years of age. By continuing to use and access this Site you are confirming you are at least 18 years of age. You agree that we may delete your registration and remove your confession from the Site without warning if we believe for any reason that you may be under 18 years of age.
4) Signing Up
You are required to sign up before you are able to upload your confession onto the Site. MyConfession is under no obligation to accept a request to sign up and reserves the right to suspend or terminate access at any time and remove your confession(s) if your use is believed to be in breach of the Terms. By signing up you agree that all information you provide is accurate and complete. Furthermore, you agree you will update your details promptly if they change.
4) Your Username and Password
When you sign up with us you will be asked to choose your own username and password which will be unique to you. It is your responsibility that your username and password are kept confidential and are not used by anyone else.
5) Your Conduct
MyConfession wants you to have fun and enjoy the Site however it is important that the files you upload on the Site do not contain any material and/or references to any incidents that are unlawful, offensive, defamatory, obscene or which may cause offence or distress or which may infringe the rights of any other person. Material that contains pornographic or sexually explicit content, dangerous or illegal acts, drug use and/or the use of controlled substances, graphic or gratuitous violence, breach of a third party trademark rights, contain libellous or defamatory comments, malicious use of stereotypes, or acts and/or comments intended to offend, demean, attack a particular age, race, sex or sexual orientation must not be uploaded onto the Site. MyConfession reserves the right to suspend and/or terminate your sign up to this site at any time and remove your confession(s) in the event it considers for any reason that you are in breach of the Terms. MyConfession takes all violations of the Terms seriously, and encourages you to contact support@myconfession.com in the event you discover any material on the Site that does not comply with this section and/or the Terms.
6) Copyright
You represent that you either own all copyrights in the material you upload onto the Site or you have express permission from all copyright owners to upload the material you upload onto the Site. You represent that no materials of any kind submitted, transmitted, shared or otherwise posted on the Site by you will violate upon the copyright of any third party. MyConfession respects the intellectual property rights of others.

7) Content Uploaded onto the Site
MyConfession may delete any material uploaded onto the Site if in its sole judgement it breaches the Terms. MyConfession assumes no responsibility for monitoring the Site for inappropriate material or conduct/views posted by users. If, at any time, MyConfession decides at its sole discretion to monitor material uploaded and/or a user’s conduct/views posted on the Site it nonetheless assumes no responsibility in respect of the material uploaded or the conduct/views posted by the user.
You are solely responsible for the material you upload and the views you express on the Site. MyConfession does not endorse or have any control over the material you upload and the conduct/views you express. The material you upload and your conduct/views are not necessarily reviewed by MyConfession before they are posted on the Site and they do not necessarily reflect the opinions or policies of MyConfession. MyConfession does not make any warranties, express or implied, as to the accuracy or truthfulness of the material uploaded by you and/or your conduct and/or views you express to other persons on the Site.
8) Disputes
You are solely responsible for your interactions with all third parties who use and/or sign up to the Site. MyConfession reserves the right, but has no obligation, to monitor disputes that may arise on the Site.
9) Your Ownership of the Content you Upload
Except for the limited non-exclusive license you grant MyConfession specified in section 11 below, we agree that we have no right, title or interest from you (or you licensors and/or assignors) under these Terms in any of the content you upload, post, transmit or display on the Site, including any intellectual property rights which may subsist in the material you upload on the Site. By uploading, submitting, posting or displaying your material on the Site, you agree that you are responsible for protecting and enforcing all rights you have in the material and that MyConfession has no obligation to do so on your behalf.
10) The License from you
By uploading, submitting, posting or displaying your material on the Site you give MyConfession a perpetual, irrevocable, worldwide, royalty-free and non-exclusive license to reproduce, modify, change, publicly perform, publish, publicly display, translate and distribute your material and/or the views and comments you express on the Site.
11) MyConfession Services
You agree that MyConfession own the legal right and interest in MyConfession’s materials, products, services and Site (“the Services”) including any intellectual property rights which may subsist in the Services (whether those rights have been registered or not, and no matter where those rights may exist). Furthermore, you agree that unless you have received MyConfession’s express consent in writing, the Terms do not give you a right to use any of MyConfession’s materials, trade marks, logos, domain name or any other distinctive features to our brand.
12) Indemnity
You agree to indemnify MyConfession and hold MyConfession’s subsidiaries, affiliates, employees, agents, partners and third-party advertisers on the Site, harmless from any claim or demand, including legal expenses, made by any third party due to or arising from the material you upload, submit, post or display on the Site, your use of the Service, your connection with the Service, your breach of the Terms, or your violation of any rights of any third party.
MyConfession has no liability to you (whether under contract, tort or otherwise) for any direct, indirect, incidental, special or consequential loss or damage suffered or incurred by you or for any loss of profits, loss of data, loss of contracts, loss of goodwill or loss of anticipated savings arising out of your use of the Site.
13) Advertising
MyConfession and third party advertisers may promote their goods and services on the Site. MyConfession does not endorse the products or services offered by third party advertisers, or give you any assurance that they are suitable for your needs. You assume sole responsible for satisfying yourself in this regard and agree MyConfession is not liable in connection with this.
Third party advertisers may provide links from this Site to websites that are owned or controlled by them. The links they provide are provided for your convenience and MyConfession has no control over and is not liable in respect of those third party websites.
14) Site Availability
Access to this website is provided free of charge and MyConfession does not guarantee that your use of the Site will be timely, secure, uninterrupted or error free. MyConfession reserves the right to modify, suspend or withdraw the whole or part of any content featured on the Site at any time without notice and without incurring any liability.
15) Termination
You agree that MyConfession may, in its sole discretion, at any time and without giving prior notice, terminate your username, password and your use of the Site, and remove and discard any materials you upload, post or submit on the Site and any views or comments you express on the Site, for any reason including but not limited to our belief that you have breached or acted inconsistently with the letter or spirit of the Terms. Furthermore, you agree that MyConfession will not be liable to you or any third party for any termination of your username, password or your use of the Site.
16) Your Personal Information
MyConfession takes the security of your personal information seriously. All personal information you provide will be held securely and in accordance with the Data Protection Act 1998 and these Terms. MyConfession will primarily use your personal information to provide the services you request from us, to communicate with you in the event that any services you have requested are unavailable, to carry out market research so that we can improve the services we offer, to analyse activity on the Site and to create a profile of you so that we can enhance your experience, understand your preferences and provide you with relevant offers and opportunities where you have agreed to receive them.
We may need to disclose your personal information to a third party so that they can provide you with the product or service you have requested. In these circumstances any information that we pass to a third party will be held securely by that party, in accordance with the Data Protection Act 1998, and used only to provide the product or services you have requested.
17) Law and Jurisdiction
By visiting and/or using the Site, you agree that the laws of England and Wales will govern these Terms and any dispute that may arise between you and MyConfession and/or any of its subsidiaries, or affiliates, employees, agents, partners and third-party advertisers in relation to your use of the Site and/or our Services will be subject to the jurisdiction of the Courts in England and Wales.
18) Use of the Site outside England and Wales
MyConfession makes no claims or representations that any or all of the content of this Site may be lawfully viewed or downloaded outside England and Wales . If you choose to access the Site outside England and Wales , you agree that you are doing so at your own risk and that you are solely responsible for compliance with the laws of your jurisdiction.
